Fitji is a movement-powered companion app in closed beta. You may use it for personal, non-commercial enjoyment as long as you follow these terms and applicable law.
Pay attention to your surroundings and choose activity that is appropriate for you.
Features, progress, availability, and even very opinionated eggs may change.
Do not cheat, scrape, disrupt, reverse engineer, or misuse Fitji or other players.
Your agreement with Fitji
These Terms & Services (the “Terms”) apply to the Fitji mobile app, closed beta, getfitji.com, and related support services (together, the “Services”). Fitji is created and operated by DJ and Han Jin. In these Terms, “Fitji,” “we,” “us,” and “our” refer to the people operating the Services.
By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you use Fitji for an organization, you confirm that you have authority to accept these Terms for that organization.
Fitji is a closed beta
Fitji is still being shaped. Features may be incomplete, unavailable, or changed without notice. Art, animations, balance, gameplay mechanics, availability, compatibility, and performance are not final. We may add or remove features, reset progress or test data, limit participation, or end the beta.
Beta access is provided for testing and feedback. Please back up anything important that the Services allow you to export. Do not rely on Fitji as the only copy of information you need to keep.
Eligibility and accounts
You must be at least 13 years old, or the higher minimum age required where you live, to use Fitji. If you are not old enough to enter into a binding agreement where you live, a parent or legal guardian must review and accept these Terms for you.
Provide accurate account information, keep your sign-in credentials secure, and tell us promptly if you believe your account has been accessed without permission. You are responsible for activity through your account unless applicable law says otherwise. You may not sell, transfer, rent, or share access to your account.
Movement, health connections, and safety
Fitji can use movement and wellness information from iOS Health or Health Connect when you grant permission. You control those permissions through your device and connected service. Our Privacy Policy explains how Fitji handles that data.
Do not look at or interact with Fitji while driving, crossing traffic, or doing anything that requires your full attention. Choose routes and activities that are safe and lawful, and stop if you feel unwell or conditions become unsafe.
Fitji is for general movement, motivation, and entertainment. It is not medical advice, diagnosis, treatment, emergency support, or a substitute for a qualified professional. Step counts and other activity information can be delayed, incomplete, or inaccurate due to device settings, permissions, sensors, or third-party services.
Your license and acceptable use
As long as you follow these Terms, Fitji gives you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for non-commercial purposes. Fitji and its licensors keep all rights not expressly granted to you.
You may not:
- break the law, infringe another person's rights, harass others, or submit harmful or misleading content;
- cheat, falsify movement, exploit bugs, automate gameplay, manipulate rewards, or bypass feature limits;
- probe, scan, disrupt, overload, damage, or gain unauthorized access to the Services or related systems;
- copy, scrape, crawl, resell, sublicense, or commercially exploit the Services or their content without written permission;
- reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits it;
- upload malware or use Fitji to send spam, advertising, or unauthorized promotions; or
- help someone else do any of the above.
Reasonable security research must follow our published security guidance and must not harm users, access data without permission, or disrupt the Services.
Your content and beta feedback
You keep ownership of content you submit, such as written feedback and support messages. You give Fitji a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, and display that content only as needed to operate, support, secure, and improve the Services. This license ends when the content is deleted from our systems, except where retention is reasonably necessary for legal, security, or backup purposes.
Suggestions, ideas, votes, and feature feedback may be used without restriction or payment to you. That lets us build on beta feedback without creating an ownership puzzle every time the egg gets a new idea. Do not submit anything you do not have the right to share.
Virtual items and rewards
Fitji may include mushrooms, collectibles, companion items, rewards, progress, and other virtual content. These are licensed features of the Services, not money or property. They have no cash value, cannot be redeemed outside Fitji, and may not be sold or transferred unless Fitji expressly allows it.
We may adjust, rebalance, limit, or remove virtual items and rewards as the beta changes. If paid features are introduced, additional purchase terms and the applicable app store's payment and refund rules may apply before you buy anything.
Third-party services
Fitji may connect with Apple, Google, TestFlight, Google Play, iOS Health, Health Connect, and other providers. Their services, availability, terms, and privacy practices are their responsibility. Fitji is not responsible for third-party services, and your use of them may be subject to separate agreements.
Fitji's content and ownership
The Services, including software, designs, characters, artwork, text, animations, sounds, branding, and other content provided by Fitji, are owned by Fitji or its licensors and are protected by intellectual-property laws. “Fitji” and related branding may not be used in a way that suggests sponsorship or endorsement without written permission.
Suspension, termination, and service changes
You may stop using Fitji at any time. You may request account deletion as described in our Privacy Policy. We may suspend or end access if you materially or repeatedly violate these Terms, create risk or legal exposure, misuse the Services, or if operating the Services is no longer practical. When reasonable, we will provide notice and an opportunity to appeal.
Provisions that logically need to continue after access ends will survive, including those about ownership, feedback, disclaimers, limits of liability, disputes, and amounts owed.
Disclaimers and limits of liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Fitji disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that Fitji will always be available, secure, error-free, accurate, or compatible with every device or connected service.
To the fullest extent permitted by law, Fitji and its creators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, progress, profits, goodwill, or opportunities arising from the Services. Fitji's total liability for claims related to the Services will not exceed the greater of the amount you paid Fitji in the 12 months before the claim or US $100.
Some places do not allow certain warranty disclaimers or liability limits. In those places, these provisions apply only to the maximum extent allowed, and your non-waivable consumer rights remain intact.
Your responsibility for misuse
To the extent permitted by law, you agree to defend, indemnify, and hold Fitji and its creators harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the Services, your content, or a material violation of these Terms. This does not apply where the claim results from Fitji's own misconduct or where local law does not permit it.
Changes, disputes, and general terms
We may update these Terms as Fitji changes. We will update the date above and provide additional notice when a change is material. Continuing to use the Services after updated Terms take effect means you accept them. If you do not agree, you must stop using Fitji.
Before filing a formal claim, please contact us and give us 30 days to try to resolve it informally. These Terms are governed by the laws of California, excluding conflict-of-law rules, except where the mandatory laws of your home jurisdiction apply. Courts with proper jurisdiction in California will hear disputes that cannot be resolved informally, unless applicable consumer law lets you bring a claim elsewhere.
These Terms and the Privacy Policy are the entire agreement about the Services. If one provision is unenforceable, the rest remain in effect. Our delay in enforcing a provision is not a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a reorganization, financing, acquisition, or sale of the Services. No third party is a beneficiary of these Terms unless expressly stated.
